Terms of Service
By commissioning me, you agree to the following terms and conditions:1. I reserve the right to refuse service to any customer, for any reason.2. Age requirements: You must be 18 years or older to commission me.3. Deadlines: Deadlines may be accepted depending on workload and availability. Please contact me to confirm if your requested deadline is workable. Please note that I reserve the right to charge an additional fee in case work needs to be expedited.4. Payment and Fees: I accept both upfront payment and payment plans, subject to individual agreement by myself.- 4a. Upfront payments: Payments for commissions must be made in full within 30 days, unless otherwise agreed. Payment should be made through PayPal, using an invoice that will be sent upon agreement to undertake the work. Work will not begin on the commission until payment is made, and failure to pay within the 30 day timeframe may result in the cancellation of your commission and loss of your slot.- 4b. Payment Plans: I may offer payment plans for commissions on a case-by-case basis. A deposit of at least 30% of the commission price is required to secure your slot. Payments must be made according to the agreed-upon schedule. Failure to communicate and make payments on time may result in the cancellation of your commission and loss of your slot.5. Refunds: are only accepted if work has not yet started. Refunds will be for the full amount paid, less any unrecoverable costs related to your commission, such as completed purchases for specific avatar/software licences, etc. Any chargebacks will result in your commission being cancelled and blacklisted from future commissions. Should a fraudulent chargeback be filed, I reserve the right to publicise a warning, to alert others of this behaviour.6. Quotes: Any quotes given will be held indefinitely, but pricing is subject to change after 30 days of the quote being made. Customers will be notified of any changes in pricing before work on the commission begins.7. Avatar Requirements: To ensure I am in compliance with the ToS of the appropriate avatar/model being used, I reserve the right to request evidence of licence ownership by you. For example, a screenshot of invoice, copy of licence, etc. If a licence is required to complete the work, the cost of this is the responsibility of you, and the price of this will be added to the commission price. Please ensure you are in compliance with the ToS of the respective avatar/model you wish for me to work with, such as the requirement for an artist to own a copy of the avatar. If it is found the ToS are being broken, I reserve the right to cancel the commission without refund.8. Final Product: The final product will be provided as a Unity Project in .ZIP file format. The file will allow for upload to VRChat for PC only. If you require the final project in another format, please request this beforehand so I can confirm this is possible.9. Display of Work: I reserve the right to display the avatar on social media platforms, such as Twitch, Twitter or your website as part of your portfolio, or for tutorial purposes. If you would prefer the character was not used for this purpose, you should advise me before work is started.10. Failure to comply with any of these terms may result in the cancellation of your commission and the loss of your slot.
CHANGE POLICY
Minor changes or tweaks can be made to commissions before the work is completed, such as minor adjustments to colouring or small additions to the design. However, if more than 5 minor changes or 1 major change (such as a significant alteration to the character design) is requested, a fee may be charged to cover additional time and resources. Any additional fees will be communicated to the customer and agreed upon before work on the commission continues.In addition, rush orders may incur additional fees due to the need for the artist to prioritize and expedite the commission process. The customer will be informed of any rush fees before work on the commission begins.
ORIGINALITY AND RESPECT FOR OTHERS' INTELLECTUAL PROPERTY
1. Original Characters: I will not copy another person's character or fursona design without their express permission. If it is discovered that you have provided me with references to another person's original character without their permission, the commission will be cancelled and all materials will be stripped.2. Copyrighted Characters: Due to copyright laws copyrighted characters are prohibited. However, if you want a character inspired by something in particular, we may be able to work something out.3. Closed or Restricted Species: To ensure that the commission is in compliance with the rules of the appropriate species being used, the commissioner and the artist must both respect the ToS of the species in question. This includes any restrictions on the use of the species, such as the prohibition of adding genitalia to certain species, and any other requirements specified by the avatar/species owner. If it is found that the ToS are being broken, the commission may be cancelled without refund.
